NSM Consumer Health Data Privacy Notice

This Consumer Health Data Privacy Notice (“CHD Notice”) supplements NSM Privacy Notice and Notice of Client Privacy Practices, and applies to “consumer health data” subject to the Washington My Health My Data Act (“MHMDA”) and/or other applicable state consumer health privacy laws. For purposes of this CDH Notice, “NSM” refers to National Seating & Mobility, Inc., and its subsidiaries (collectively known as “we”, “our”, or “us”). “Consumer health data” does not include publicly available information, PHI subject to Notice of Client Privacy Practices, or deidentified information that cannot reasonably be used to infer information about, or otherwise linked to you or your device(s). Individuals who interact with NSM are referred as “you” or “your.”
Washington Residents
Categories of Consumer Health Data We collect: We may collect or process the following categories of consumer health data as it identifies a consumer’s past, present, or future physical or mental health status:
- Information about your health-related conditions, treatment, diseases, diagnosis, testing, treatment (including surgeries, procedures, medications, or other interventions). For example, we may collect information about individuals’ purchases of, or product inquiries about, mobility solutions, wheelchairs, and related equipment or services (“NSM Offerings”);
- Information identifying bodily functions, vital signs, or symptoms, including photographs in connection with use of mobility solutions, which may be considered also as a “biometric data” under the Washington MHMDA;
- Information collected in connection with receiving NSM Offerings, such as your health insurance information and benefits, or certain purchases made using your health insurance;
- Information that could identify your attempt to seek health care services; or
- Other information that may be used to infer or derive data related to the above or other health information.
Sources of Consumer Health Data: We may collect consumer health data directly from you, from your interactions with our websites or NSM Offerings, from third parties, and from publicly available sources.
Sharing of Consumer Health Data: We may share each category of “consumer health data” outlined above with your consent, or as necessary to complete or facilitate certain transactions (including fraud detection), provide and improve NSM Offerings, fulfill our legal obligations, respond to legal requests, or comply with applicable laws.
Third Party Recipients with Which We May Disclose Consumer Health Data: We may disclose consumer health data with the following categories of third parties:
- Service providers, including those entities we engage to provide customer services, IT services, insurance claim processing, and other business functions for and on behalf of NSM.
- Corporate Subsidiaries and Affiliates, with which we share common data systems or where access helps us to provide NSM Offerings and operate our business. These entities within NSM family of companies are: Hudson Home Health Care, Inc. d/b/a National Seating & Mobility, NE, Home Medical Equipment LLC, and Travis Medical Sales Corporation.
- Government agencies, when doing so is necessary to comply with applicable laws or respond to valid legal processes.
- Insurance payers in connection with claim processing, reimbursement, or related activities to facilitate consumers’ access to mobility solutions.
Further, we may disclose consumer health data with our distribution partners and payment processors as necessary to provide NSM Offerings, in connection with M&A transactions, change of control, or sales of substantially all NSM assets, or other third parties in a manner consistent with the foregoing business purposes. Such disclosure is not treated as “sales” or “sharing” of consumer health data under the MHMDA.
How to Exercise Your Consumer Rights: Subject to certain exceptions, Washington residents have the right to (1) confirm whether we process your consumer health data and access such data; (2) confirm whether we have shared or sold your consumer health data, including a list of recipients of the shared or sold consumer health data; (3) withdraw your consent or authorization relating to our collection and sharing your consumer health data; (4) delete your consumer health data; and (5) appeal our decision with respect to your request to exercise one or more of the foregoing consumer rights.
